Terms
Terms of service
The rules for using SpecCapture, in plain words.
Last updated
Draft. These terms have not yet been reviewed by a lawyer, and they will be before SpecCapture opens to the public. Anything in [square brackets] is a placeholder that is not decided yet.
Who we are
SpecCapture is operated by [the legal name of the company that operates SpecCapture] ("we"). "You" means the organization whose workspace uses SpecCapture, and the people it invites into that workspace.
Not for export-controlled drawings
SpecCapture is not built for export-controlled technical data. You will not upload, or send through the API, anything controlled under the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR), other than items classified EAR99 or needing no license; anything classified or marked as Controlled Unclassified Information (CUI); or anything carrying distribution statement B, C, D, E or F.
Your files are stored in the United States, but the AI services that read them may run outside it, so such data must never reach us.
Before a workspace's first upload, or its first API key, its owner or an admin confirms this in the app, once for everyone in the workspace, and we record who confirmed it and when. Everyone who uploads afterwards is reminded of it. The sentence they confirm is:
I confirm that we will not upload export-controlled drawings (ITAR or EAR) to this workspace, and I understand that SpecCapture is decision support, not a substitute for checking the drawing.
If something export-controlled reaches us anyway, tell us and we will delete it [and confirm in writing].
Decision support
SpecCapture is decision support. It reads drawings with AI, checks what it reads, and flags the values it is unsure of, but it can be wrong. A person at your organization checks values against the drawing before they are relied on, and you are responsible for the values you use in your quotes, ERP, purchasing and production.
[Warranty disclaimer and limitation of liability: to be written with a lawyer.]
Your drawings
Your drawings and the values read from them are yours, and we use them only to provide SpecCapture to you. How long drawings are kept, where they are stored and how they are kept apart from other customers' is set out on the trust page; what we do with your information, on the privacy page.
Credits and payment
Reading one drawing sheet uses 4 credits, and a sheet that cannot be read is refunded. The plans and their prices are on the pricing page.
[Refunds: credits already used to read a sheet are not refunded. Placeholder, to be confirmed with a lawyer.]
Ending
Your workspace's owner can delete the workspace at any time, from its settings in the app. [When and how we may suspend or end an account: to be written with a lawyer.]
Changes to these terms
[How changes to these terms are announced, and when they take effect: placeholder.]
Governing law
[Governing law, and where disputes are heard: placeholder, to be decided with a lawyer.]
